Terms and Conditions

Below are the standard provisions set forth by H3 Mobile Entertainment, LLC. Please contact H3 Mobile Entertainment, LLC for any additional questions or concerns.

Reservation Deposit

At the time of booking, Customer (also known as Party Host) authorizes H3 Mobile Entertainment, LLC to charge a non-refundable deposit in the amount of $50 the quoted price for reservation of the event. Events booked online are for private small events (15 participants or less for Extreme Gaming Bus/Unlimited Participants for Laser Tag & Foam Parties). These pricing packages are not valid for larger group or public events. If you are interested in discussing options for a large event, please contact us directly so we can assure that we are able provide you and your guests with an exceptional H3 Mobile Entertainment, LLC experience.  Larger events require additional staff to handle such.

Payment Terms

Customer authorizes H3 Mobile Entertainment, LLC to charge the remaining invoice balance beginning 48 hours prior to the event, although in many instances final payment is collected at the conclusion of your event. Cancellations within that 48 hours have a No Refund Policy.  Please check the weather before making your final payment.

Cancellation Policy

Because people often book parties well in advance, customer recognizes that times reserved are in short supply. Therefore, should Customer request a cancellation within 5 days of the event, or Customer is a no show for the event, the full remaining balance of the invoice will be due.  Deposits are non-refundable as you have taken a slot that another customer could have reserved.

Cancellations due to potential or verified COVID cases will be rescheduled no earlier than 10 days from a reported positive COVID test.  If no date and time is applicable, the initial $50 refund takes the place of that particular slot with no refund.

Weather Policy

H3 Mobile Entertainment, LLC will make every reasonable attempt to deliver an event. Forecast of bad weather is not an exception to the cancellation policy. However, if an event is affected by unsafe weather (tornado warnings, high winds, heavy snow, unsafe roads, or flooding), H3 Mobile Entertainment, LLC reserves the right to reschedule your event. No refund will be issued for this reschedule or if cancelled.  In the event that a party is started and is interrupted by weather conditions, there will be no refund or rescheduling.  Please check the weather at least 2 days prior to your party to determine if it is applicable to setup.  There are no refunds or rescheduling for the same fee after we pull up to the event location and setup.

Parking Policy

For Video Game Parties, prior to arrival please allocate 60 feet (approximately 7 parking spaces) for the game trailer to park that is free of hazards and foot traffic. To avoid damage to customer and H3 Mobile Entertainment, LLC property, we reserve the right to refuse to pull the gaming bus onto customer property. Delays caused by clearing space for the truck and trailer will not prevent us from leaving at the scheduled time.

A permit is only required if we will need to park in a “No Parking” zone. H3 Mobile Entertainment, LLC gaming bus is no wider than any contractor or landscaper vehicle and in most cases parking outside the home at the curb is not an issue. If a parking permit is required it will be the responsibility of Customer to arrange for one.

H3 Mobile Entertainment, LLC Terms of Service and Privacy Policy

1. Terms

By accessing the website at https://h3mobileentertainment.com, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Use License

1. Permission is granted to temporarily download any type of the materials (information or software) on H3 Mobile Entertainment, LLC’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
   1. modify or copy the materials;
   2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
   3. attempt to decompile or reverse engineer any software contained on H3 Mobile Entertainment, LLC’s website;
   4. remove any copyright or other proprietary notations from the materials; or
   5. transfer the materials to another person or “mirror” the materials on any other server.
2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by H3 Mobile Entertainment, LLC at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Disclaimer

1. The materials on H3 Mobile Entertainment, LLC’s website are provided on an ‘as is’ basis. H3 Mobile Entertainment, LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
2. Further, H3 Mobile Entertainment, LLC does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall H3 Mobile Entertainment, LLC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on H3 Mobile Entertainment, LLC’s website, even if H3 Mobile Entertainment, LLC or a H3 Mobile Entertainment, LLC authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Accuracy of materials

The materials appearing on H3 Mobile Entertainment, LLC’s website could include technical, typographical, or photographic errors. H3 Mobile Entertainment, LLC does not warrant that any of the materials on its website are accurate, complete or current. H3 Mobile Entertainment, LLC may make changes to the materials contained on its website at any time without notice. However, H3 Mobile Entertainment, LLC does not make any commitment to update the materials.

6. Links

H3 Mobile Entertainment, LLC has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by H3 Mobile Entertainment, LLC of the site. Use of any such linked website is at the user’s own risk.

7. Modifications

H3 Mobile Entertainment, LLC may revise these terms of service for its website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of TN and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

Equipment Use

Care and Use.

H3 Mobile Entertainment, LLC’s provides top of the line video gaming and laser tag equipment for your enjoyment.  In the event that equipment is damaged at your party, you are responsible for the quick and timely reimbursement to replace equipment.  This includes equipment that is dropped and/or thrown to the point that it affects its use (whether accidental or intentional), damaged television screens, damaged consoles, damaged laser tag gun & headbands, and any other equipment or items that may be damaged while servicing your party.  This also includes damage to our Extreme Gaming Bus and Extreme Gaming Van once it pulls upon your property or the street for the purpose of providing services for your event.

We will always provide you with a fair market value for the replacement of damaged equipment.  H3 Mobile Entertainment will not seek used or refurbished equipment for replacement.  Replacement will be new equipment from a national retail brand, whether online or physical location.

Video Games

H3 Mobile Entertainment, LLC provides consoles containing various video games.  Party host and/or parents allowing minors to attend a party are fully responsible for what games the participants may or may not play.  H3 Mobile Entertainment, LLC does not deny play of any games for the parties as games are selectable on each console.  If there are game restrictions, please provide an adult 18 or over to ensure that event participants are not playing inappropriate games.  Games such as Grand Theft Auto require that ALL participants on the Extreme Gaming Bus or the Extreme Gaming Van be at least 13 years of age or older.  If any minors are younger than 13, we do not allow such game play by those 13 and above.  

Video games are complimentary.  Some games are downloaded directly to the consoles while others are supplied on a game disc or cartridge.  As a party host, you are responsible to ensure that no games are taken (whether by mistake or intentionally) by party participants.  As an acceptance of this agreement, you agree to reimburse H3 Mobile Entertainment, LLC for any game(s) that are lost or stolen when servicing your event.  Game titles are inventoried prior to the events and may not be inventoried until the setup of the next event.  H3 Mobile Entertainment, LLC must be reimbursed for any lost or stolen games within 24 hours of notification to the party host (customer).

Party Host Responsibilities for Participants

Your Parents and/or party hosts are responsible for ensuring that all of their participants act with respect and do not create any type of hostile environment with H3 Mobile Entertainment staff or other participants.  Party Hosts are also required to have an adult on premises for all participants under the age of 18.  For children 7 and under, an adult is required at all times to be on the video gaming bus or video gaming van. 

For Laser Tag participants, parents and/or party host will need to ensure that the kids are able to hold the equipment appropriately.  Any damages to the equipment require a replacement of the said equipment within 3 days of notice of damage.  Laser Tag guns that H3 Mobile Entertainment, LLC utilizes start at $1100 each with the Battle Company.  Headbands and other equipment vary and will be charged for the current market value including shipping and handling.

For Foam parties, it is the responsibility of the parent and/or party host to ensure that participants can participate without issue.  If a person suffers from any type of severe allergies, it is recommended that they do not participate in any type of foam parties.

Damaged Property

H3 Mobile Entertainment, LLC’s prefers to pull the Extreme Gaming Bus and the Extreme Gaming Van in front of your property on the street.  At times, a customer may want the vehicles to pull in the driveway.  With the large size of the Extreme Gaming Bus, H3 Mobile Entertainment, LLC will not be responsible to damaged lawns or times that may be in the immediate space where the bus is attempting to park, including the pathway prior to fully parking.  Our preference is on the street with a clearance of at least 60 feet.  Please ensure that other vehicles are not within the 60 feet of intended space to allow for adequate room for the bus to park.

Privacy Policy

Your privacy is important to us.

It is H3 Mobile Entertainment, LLC’s policy to respect your privacy regarding any information we may collect while operating our website. Accordingly, we have developed this privacy policy in order for you to understand how we collect, use, communicate, disclose and otherwise make use of personal information. We have outlined our privacy policy below.

1. We will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned.
2. Before or at the time of collecting personal information, we will identify the purposes for which information is being collected.
3. We will collect and use personal information solely for fulfilling those purposes specified by us and for other ancillary purposes, unless we obtain the consent of the individual concerned or as required by law.
4. Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.
5. We will protect personal information by using reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification.
6. We will make readily available to customers information about our policies and practices relating to the management of personal information.
7. We will only retain personal information for as long as necessary for the fulfilment of those purposes.
8. H3 Mobile Entertainment, LLC will take photos and videos for our social media posts and also for our website.  No personal identifiable info other than a first name is typically used for such posts such as “Happy Birthday, John!”.  Please inform H3 Mobile Entertainment, LLC in writing at least 2 days prior to your party if you would not like for any photos or videos to be taken.  As a courtesy, please also notify us upon arrival in case electronic communications are missed.  Otherwise, it is implied that photos and videos are OK.

We are committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is protected and maintained. H3 Mobile Entertainment, LLC may change this privacy policy from time to time at H3 Mobile Entertainment, LLC’s sole discretion.

I have read and understand the rules, including all safety-related rules, and agree to fully comply with all rules and regulations during participation.

I acknowledge, understand and agree that I have read this release of liability and assume all risk associated with participating and that I sign this release of liability voluntarily and without inducement.
